Man charged in Oxbow woman's death remains in custody

REGINA - One of the two men accused in the death of Briana Hayes in Oxbow last year is still in custody following his most recent arrest.

Tyler Neil Shaw of Gainsborough was supposed to have a show-cause hearing on April 17 in Regina Provincial Court to determine if he would receive bail. But the hearing was rescheduled to May 22 in Regina.

Shaw was out on bail, with conditions, when he was arrested in late March and charged with impaired driving by alcohol, driving with a blood alcohol content over .08 and four counts of violating the terms of his release order.

He appeared in court in Estevan on March 31 and April 7. Estevan Provincial Court Judge Mitch Miller has said repeatedly that he is in a conflict of interest with the case. Before becoming the judge in Estevan, Miller was involved with the prosecution of Shaw and Taylor Japp, who is the co-accused in Hayes' death. 

During Shaw's April 7 court appearance, it was suggested that Shaw's bail hearing occur in Regina court rather than Estevan.

Background: On April 24, 2024, the Carlyle RCMP received a report of a possible homicide. The Saskatchewan RCMP Major Crimes Unit took control of the investigation. Hayes' body was found in a rural location in the RM of Moose Mountain around noon on April 25.

Shaw was arrested and charged the same day, while a second-degree murder charge against Japp was announced on April 26.

A preliminary hearing for Japp is set for June 2 in Carlyle. He remains out on conditions. The hearing will determine whether Japp's case will proceed to trial.
